RENT DETERMINATION AND EVICTION CASES


The lease agreement is made between the tenant and the lessor and the rental fee is mutually agreed upon. However, if a disagreement arises while deciding on the rental fee, a lawsuit for the determination of the rental fee is filed. The lawsuit for the determination of the rental fee is filed in the civil court of peace where the real estate is located. It can also be filed in the place where the defendant resides, however, since a discovery will be required during the trial in order to look at the rental income of the real estate that is rented, it would be more appropriate to file a lawsuit in the court where the real estate is located.

Although it is not a legal obligation to send a prior notice to file a lawsuit for the determination of the rent, sending a notice is important both in terms of determining whether the tenant will comply with the requested rent, in terms of determining the period in which the rent will be determined, and in terms of the duration of the lawsuit.
